Please read these terms before submitting a survey or cart request.

These Terms of Use (“Terms”) govern access to expiredhomesurvey.com (the “Site”), including the home condition questionnaire, featured property pages, frequently asked questions, contact form, email preference pages, and the client-side cart. By using the Site you agree to these Terms. If you do not agree, do not use the Site or submit a form.
Expired Home Survey provides educational content and structured questionnaires that help households in the United States describe appliance condition, heating and cooling equipment, plumbing symptoms, electrical observations, and routine maintenance. The Site is especially useful when a listing has expired or is about to return to market and the owner wants a clearer written story of kitchen equipment, laundry pairs, water heaters, condensers, furnaces, and seasonal upkeep.
The Site is a static, client-side experience. Forms validate in your browser. The cart stores package selections in local storage on your device. Checkout does not process cards, create a merchant charge, or transmit payment to a server from this template. A confirmation message means your request was recorded on this device so that a representative may follow up using the email you typed—not that a paid inspection has been scheduled.
Nothing on the Site is a home inspection as defined by state licensing boards, the American Society of Home Inspectors, InterNACHI, or similar bodies. Nothing is an appraisal, energy audit, mold assessment, radon test, pest inspection, septic evaluation, or engineering report. We do not open electrical panels, recover refrigerant, light gas pilots, climb roofs, enter confined crawl spaces, or certify that a dwelling is safe to occupy.
If you smell gas, see burning at an outlet, hear a carbon-monoxide alarm, or observe structural movement, stop using questionnaires as a substitute for emergency services and licensed trades. Appliance “condition” answers you type are owner observations, not laboratory tests or manufacturer diagnostics.
The Site is intended for adults who can form a contract under the law of their U.S. state of residence. Content, climate notes, and featured homes are framed for the United States, including typical appliance brands, HVAC equipment, and listing practices. You are responsible for complying with local real-estate disclosure laws when you reuse any notes you create.
Featured homes are illustrative profiles used to explain how a survey package might apply to different American housing types. They are not live Multiple Listing Service offerings, not an invitation to tour a private residence, and not a representation that Expired Home Survey owns, lists, or has inspected those dwellings. Photographs are used to depict residential architecture, interiors, appliances, and maintenance work. Do not treat a sample address city or year built as a warranty about a real property you intend to buy or sell.
You agree to provide information that is truthful to the best of your knowledge. Guessing an appliance age without reading a data plate can mislead a later buyer or agent. You should not invent model numbers. If you do not know an answer, use “unknown” where the form allows it. We may refuse to follow up on submissions that appear automated, abusive, or unrelated to home systems and maintenance.
Displayed prices are estimates for survey packages described on the Site. Because checkout is client-side only, adding an item does not reserve a technician, lock a fee, or create an invoice. After you complete a validated checkout form you will see a message substantially as follows: your order has been processed and one of our representatives will contact you. That message is a request acknowledgement, not a sale of goods under the Uniform Commercial Code, not a completed inspection contract, and not a guarantee of response time.
You may remove items, change quantities, or clear browser storage at any time. We are not responsible for lost cart data if you switch browsers, use private mode, or delete site data.
The Expired Home Survey name, hexagonal house mark, layout, written survey questions, featured-home narratives, and original compilation of maintenance guidance are protected by copyright and trademark principles to the extent allowed by law. You may print or save your own form answers for personal use. You may not copy the Site wholesale, scrape content for a competing questionnaire product, or present our sample homes as your brokerage listings.
You agree not to: (a) attempt to break, probe, or overload the Site; (b) submit malware or deceptive content in form fields; (c) harvest emails from pages; (d) impersonate another household; (e) use the Site to harass occupants of any dwelling; or (f) frame the Site in a way that conceals its origin. We may block access where we reasonably believe these rules were broken.
Footer social icons open third-party sharing tools. Those services have their own terms. We do not control Facebook, X (Twitter), LinkedIn, Pinterest, or Instagram. Font and icon libraries loaded from public CDNs are provided by those vendors.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT QUESTIONNAIRE RESULTS WILL INCREASE SALE PRICE, SHORTEN DAYS ON MARKET, SATISFY A BUYER’S INSPECTOR, OR DETECT LATENT DEFECTS IN APPLIANCES, ROOFS, FOUNDATIONS, OR MECHANICAL SYSTEMS.
Maintenance suggestions (filter changes, anode rods, coil cleaning, descaling tankless heaters, dryer-vent cleaning) are general consumer education. Follow manufacturer instructions and licensed local codes, which override anything on this Site.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPIRED HOME SURVEY AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST LISTINGS, OR COST OF SUBSTITUTE INSPECTIONS, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US IN THE THREE MONTHS BEFORE THE CLAIM—OR FIFTY U.S. DOLLARS IF YOU PAID NOTHING THROUGH THIS STATIC SITE.
Some states do not allow certain limitations. In those states, our liability is limited to the greatest extent permitted.
You agree to indemnify and hold harmless Expired Home Survey from claims arising out of your misuse of the Site, your republication of sample home narratives as if they were MLS data, or your reliance on questionnaire answers in place of licensed inspections when a transaction required those inspections.
Personal information practices are described in the Privacy Policy linked in the footer. Because this build is static, much of what you type remains in your browser unless you also email us or a representative follows up.
Subscribe and Unsubscribe pages let you express a preference. Submitting those forms does not by itself create a legal duty to send or stop a particular campaign until a representative processes the request. You still agree not to subscribe addresses you do not control.
We may update these Terms by posting a new date at the top of this page. Continued use after a change constitutes acceptance. If a change is material, we may also note it on the home page banner area when practical.
These Terms are governed by the laws of the United States and the state in which a dispute is properly brought, without regard to conflict-of-law rules that would apply another jurisdiction’s law to a purely informational website. You agree to attempt good-faith email resolution before filing a claim.

These Terms, the Privacy Policy, and any package description on a page you used before checkout are the entire agreement for Site use. If a court finds one clause unenforceable, the rest remains in effect. Headings are for convenience only.
Thank you for documenting appliances and maintenance with care. Honest condition files help the next chapter of a U.S. home—especially one that has already left the market once.
